One of the things Americans have prided themselves on is that we are a nation of laws. While some of us believe that many of the laws are unnecessary, we all agree that our society would be a disaster without laws.
For example, as drivers on our streets:
- All of us must stop at a red light and only proceed when the light turns green;
- We drive on the right side of the road;
- We are not to drive on sidewalks;
- We must slow down in school zones while children are present;
- We are not supposed to drive while intoxicated.
We can find many other examples of the rule of law and why our lives would be in chaos without these laws.
Of course, if you have laws that are not enforced, then you become a country without the rule of law and this leads to disaster.
EXPOSING THE HYPOCRISY OF MANY IN CONGRESS
The Merriam Webster dictionary defines hypocrisy as: “a feigning to be what one is not or to believe what one does not: behavior that contradicts what one claims to believe or feel.” (Feigning is defined as, “to give a false appearance of: induce as a false impression.”)
All of us are familiar with Members of Congress who call themselves “law and order” supporters. They insist that our laws must be obeyed. They push to enforce our immigration laws and to imprison people who violate the law. They don’t say that only some laws need to be enforced but all laws.
However, many of these same Members of Congress act like they are not concerned with the massive illegal evasion of the income/payroll tax system. In fact, they boast that they have reduced the funding for the IRS and it now only audits about .7% of Americans. Since over 70% of these audits are correspondence audits, where the IRS sends you a written request, only about .2% of Americans are actually being visited by an IRS agent.
Doesn’t ignoring enforcing the law against illegal evasion of the income/payroll tax laws but saying they are in favor of law and order fit the definition of hypocrisy?
Tax Change and Not Tax Reform
Paul Ryan and Kevin Brady are both personally very likeable and genuinely believe that their proposed “Better Way” tax plan is good for America and is real reform.
They point to the fact that their plan:
Lowers the corporate rate;
- Changes to a territorial system used by almost all of our trading partners;
- Eliminates complicated depreciation schedules and allows expensing;
- Attempts to create a border adjustable tax like 160 of our trading partners;
- Lowers individual rates and simplifies the income tax code.
- The D.C. Elite and the lobbyists will make a fortune persuading Congress to add back more and more special benefits for their clients;
- It is pretty clear that the World Trade Organization (“WTO”) will attack the Ryan/Brady attempt to create border adjustability through the corporate income tax;
- Illegal evasion will continue and is projected to be $9 trillion over the next ten years, based on historical rates of evasion;
- Persistence of low IRS audit rates (currently just 1 of every 120 taxpayers) is likely to embolden additional taxpayers to cheat.
- The only way to reduce this evasion will be to add tens of thousands of new IRS agents who will descend on taxpayers.
Attorney Alan Dershowitz said, “Hypocrisy is not a way of getting back to the moral high ground. Pretending you're moral, saying you’re moral is not the same as acting morally.”
It is time to demand that Congress look us in the eye and tell us the truth. If they want to keep the income/payroll tax system, and tell us it is ok for more and more people to not obey the income tax laws, then they should say that. If they are going to reduce evasion of the income tax, then they must explain how they will greatly expand IRS audits.
As Abraham Lincoln said, “If you want to repeal a bad law then enforce it strictly.” One way to ensure that the demise of the income/payroll tax system is to have the taxpayers suffer the outrages from an IRS that is told that they must “collect more revenue.” Then the Congress will quickly eliminate this corrupt and destructive income/payroll tax system.
Congress can do the best thing for the U.S. by adopting the FAIRtax. Not only will it be fairer but it will also greatly reduce evasion, eliminate the IRS, restore our personal freedoms and grow the economy much faster—PASS THE FAIRTAX!
WHAT CAN EACH OF US DO
Call up the local or D.C. office of the House Member and two Senators and you can use the following script:
- I am sure that Representative ____ or Senator ____ is in favor of everyone obeying the income tax laws.
- After they assure you that their boss is not in favor of anyone breaking the law, ask if they are aware of the Cebula study showing $9 trillion of evaded income/payroll taxes over the next ten years.
- Since most will say they don’t believe their boss has seen the study, either drop off a copy or get an email address and send a copy to them for their boss.
- Say you are going to call back in a week and ask what the Representative or Senator is going to do to stop this evasion.
- In a week, call back and ask specifically what the Representative or Senator is going to do to enforce the law.
- They probably will say their boss believes that simplifying the income tax will handle the problem.
- Explain that when people evade income taxes, they are also evading the 15.3% payroll/Medicare tax and state income tax. So it is unlikely that they are going to pay 30% or 40% when they were paying 0% because they have already decided it is okay to cheat.
- Say that the only way to reduce evasion is to increase by tens or hundreds of thousands the number of comprehensive IRS audits done each year.
- Point out that Evaders do not self-identify by putting an “E” on their income tax return.
- 80% of the people likely to be audited are trying to comply, but they will be forced to endure these IRS audits as well.
- Ask if the Member is in favor of this?
- If they say no, then ask again how the Member proposes to stop people breaking the income tax laws.
- Then explain that the way to handle evasion without unleashing the IRS audits is the FAIRtax.
