We Can Repeal the 16th Amendment!
 
One of the interesting things we are now hearing about the FAIRtax is that we must first repeal the 16th Amendment.  While we agree that the 16th Amendment needs to be repealed, our “friends” who are really just critics in disguise are not trying to be helpful but to stop the FAIRtax.

Their “reasonable” argument is that unless the 16th Amendment is repealed, Congress and the President will have both a FAIRtax and an income tax.  These are the same people that say the best type of tax reform is some sort of flat, simpler income tax.  They totally ignore the fact that Congress has proven repeatedly that no simplification of the Internal Revenue Code will last.  

This “need” to repeal the 16th Amendment is promoted by these “friends” because they then say that this process will take many years and this is the reason to support their form of income tax reform.  However, history does not support this opinion.  

The Amendment Process

Article V of the Constitution sets forth two ways for an amendment to be proposed.  The first is by a vote of two-thirds of the Members of both the House of Representatives and the Senate.  The second method requires two-thirds of the legislatures of the fifty states to call for a constitutional convention for the purposes of proposing amendments to the Constitution. 

Article V provides two ways for proposed amendments to be ratified. The first way requires the approval of three-fourths of the legislatures of the fifty states.  The second way is for Congress to direct the states to establish special ratifying conventions in each state and for three-fourths of these conventions to approve the amendment.  

While some amendments have taken a long time from the time they were proposed to the time they were ratified, the 26th Amendment, giving 18-year-olds the right to vote, was proposed by the Senate and the House in January of 1971.  Three months and eight days later it was ratified by three-fourths of the states.  

In fact seven of the 27 Constitutional Amendments took less than one year to ratify.  The point is that once a real alternative to the income tax and the IRS is understood, an amendment repealing the 16th Amendment can be passed in a very short time.
